Terms of Service for Riders and Drivers
These Terms of Service (the “Terms”) govern your access to and use of the Reggflex, LLC (“Reggflex,” “we,” or “our”) mobile application and digital network (collectively, the “Platform”). By creating an account, accessing the Platform, or requesting or accepting rides, you agree to be bound by these Terms.
1. Eligibility and Accounts. To use the Platform, you must be at least eighteen (18) years old (or the minimum age to operate a vehicle in your jurisdiction), have the legal capacity to enter into a contract, and create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Acceptance of Terms. By using the Platform, you agree to comply with these Terms, our Privacy Policy, and any other policies or guidelines posted on the Platform. If you do not agree, you may not use the Platform.
3. Rider and Driver Conduct. Riders and drivers agree to behave courteously and respectfully, follow all applicable laws, and refrain from any conduct that is harassing, discriminatory, deceptive, unsafe, or otherwise inappropriate. Drivers must possess a valid driver’s license, maintain insurance and vehicle registration, and comply with our Independent Contractor Agreement. Riders and drivers must not use the Platform to engage in illegal activities or transport illegal goods.
4. Ride Requests, Cancellations, and Refunds. Riders may request rides through the Platform, and drivers may accept or reject requests. Riders may cancel a ride request, but cancellation fees may apply if the driver has already been dispatched. Refunds for cancelled or incomplete rides are subject to our cancellation policy displayed in the Platform. We reserve the right to adjust fares for reasons such as technical errors, promotional activities, or user complaints.
5. Payment. Riders authorize Reggflex and its payment processor to charge the payment method associated with their account for all fares, taxes, and fees incurred. Drivers authorize Reggflex to withhold service fees and remit earnings via the Platform. All payments are processed through third‑party payment processors; we do not store your full payment card details.
6. Limitations of Liability. Reggflex is a technology company that connects riders and drivers. We do not provide transportation services and are not a common carrier. Drivers are independent contractors, not employees or agents of Reggflex. We do not guarantee that any ride will be completed, that the Platform will be error‑free, or that drivers or vehicles will meet your expectations. To the maximum extent permitted by law, Reggflex and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, personal injury, or property damage related to your use of the Platform or transportation services. Our aggregate liability to any user shall not exceed the greater of (a) $100, or (b) the total amount paid by such user in the six (6) months preceding the claim.
7. Dispute Resolution and Arbitration. Any dispute or claim arising out of or relating to these Terms, the Platform, or the services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Miami‑Dade County, Florida, and the arbitrator’s decision will be final. You waive the right to participate in a class action or class arbitration. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
8. Termination and Account Deactivation. We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or for any other reason at our sole discretion. You may deactivate your account at any time through the Platform or by contacting us. Upon termination, your right to use the Platform will immediately cease.
9. Governing Law. These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. You agree that any arbitration or legal proceeding will be brought in Miami‑Dade County, Florida.
10. Changes to Terms. We may modify these Terms from time to time by posting the updated Terms on the Platform. Your continued use of the Platform after the effective date constitutes your acceptance of the changes.
